Regulations of Sanplast SA website using
1. These regulations specify the rights and obligations of www.sanplast.pl website Users and the website functionality rules.
2. The Users of Sanplast SA website must meet technical requirements of the IT system used by Sanplast SA, i.a. active internet connection and the internet browser installed to allow reading of the website content in the computer screen.
3. www.sanplast.pl website is available for every User. Sanplast SA reserves the possibility to introduce subjective restrictions in using some website functionality, particularly the introduction of Users registration is allowable.
4. In case of necessity of Users registration (point 3), the registration is available for adult private persons who have full legal capacity and for corporate bodies. For registration purposes, the Users might be obligated to give the following personal data: name and surname, living address, e-mail address, telephone number, VAT number or other data clearly indicated in the registration form.
5. User’s registration is made by the correct completion of the registration form which can be found in the registration website. If the User wants to register, she/he is obligated to complete all the obligatory fields of the form correctly. Filling out the registration form, the User confirms the fact of reading all the regulations content. While making the registration, the User accepts all the provisions laid out in these regulations and any other regulations that might be found at Sanplast SA website subpages. In connection with the registration, the User:
a) is obligated to give the real data at registration and during data change,
b) can have only one account,
c) agrees on processing, by Sanplast SA, of the personal data given at registration,
d) acknowledges that the personal data given are subject to personal data protection based on applicable law,
e) has the right to access and correct the personal data given during the registration process.
6. Personal data are stored by the website administrator, that is, by Sanplast SA, Wymysłowice 1, 88-320 Strzelno.
7. During registration at www.sanplast.pl the Users accept their personal data being processed for the purpose of definite service. Personal data processing for marketing purposes, in particular, sending sales information by e-mail can only be made once the User gives her/his permission for such processing.
8. Sanplast SA reserves the right to prepare summary statistics about website visits and other information connected with the website in a way that makes it impossible to identify the Users. The information will be used only for the purpose of statistics and improvement of the website functionality.
9. Users personal data are collected and processed based on the consent given by the User and valid regulations on personal data protection.
10. When the User visits www.sanplast.pl website, a so-called cookie files are placed in his/her computer. These cookie files are read during next visits at the site and allow for the improvement of the website operation. 11. Sanplast SA reserves the right to introduce registration charge or charge for website usage.
12. Sanplast SA reserves the right of stop or suspend, without prior warning, the functionality of all website and any part of it.
13. Sanplast SA reserves the right to refuse User’s registration or remove his/her account if the User registration or the way of account use contravenes valid regulations, social cooperation rules (therein etiquette) or any point of the Regulations.
14. Sanplast SA reserves the possibility to introduce the products sales by Internet. Information about the available Sanplast SA products is placed at www.sanplast.pl website.
15. Users orders are received through www.sanplast.pl website. When the User sents the order, he gets a return e-mail which confirms placing an order.
16. Buying through www.sanplast.pl website means the acceptance of the regulations.
17. When the User places an order thorugh website, he/she enters into a sales contract for the goods ordered with Sanplast SA.
18. At order, the Client :chooses the goods, defines delivery address and invoice address (it can be different address).
19. The orders placed through the website can only be paid by the User as cash on delivery.
20. The given order will be proceeded with provided that the product is available in Sanplast SA warehouse. In case of inaccessibility of part or all of the goods ordered, the User is informed about this fact and takes a decision about the way of order procesing (partial delivery or order cancellation).
21. In case of product inaccessibility and impossibility of User’s order processing, Sanplast SA has the right to cancel the contract within 30 (thirty) days from the date of its conclusion.
22. Limited quantity of products is reserved for promotional sales. This type of orders might be procesed based on special conditions defined by Sanplast SA
23. All product prices at www.sanplast.pl website are presented in polish zloty (net price with VAT tax).
24. The price indicated next to the product is binding at the time of placing an order by the User.
25. Sanplast SA reserves the right to change products prices in the offer, introduce new products, perform and revoke promotions or introduce changes in the promotions. The above right does not have any influence on the product price in the orders placed before the date of price , promotions or sales conditions changes coming into force.
26. Current information about delivery cost of the goods purchased is available on the website. Delivery cost depends on the weight of the parcel.
27. Sanplast SA is not responsible for failure or delay in delivery caused by the improper or imprecise address given by the User.
28. Sanplast SA is not responsible for failure or delay in delivery caused by faulty post operation.
29. The User, buying the product through the website, has the right to complain in case the product delivered has got: factory fault, mechanical damage in transport or non-compliance of the product delivered with the one ordered. In such case, the Buyer should send the product back with the indication of failure, damage or non-compliance by economic post to the address: Sanplast SA, Wymyslowice 1, 88-320 Strzelno. The purchase document should be attached to the product. Sanplast SA does not accept any return delivery sent by cash on delivery.
30. In case the complaint is justified (point 29 of the regulations), the damaged product is repaired or replaced with free of fault one, in case it is not possible (e.g. due to unavailability of the product), Sanplast SA gives back the product price paid by the Buyer. Sanplast SA pays back delivery cost of the returned product, just after the approval of the complaint.
31. In accordance with the Act of 2 March 2000 on the protection of certain customers rights and on the liability for damage caused by a dangerous product, the Buyer being a customer can return the product purchased without giving excuse within 10 days from the date of delivery receipt. It is possible only if the product is not used or damaged in any way. Returned products have to be complete. Returned product has to be sent back with the purchase document included. Sanplast SA guarantees to give back amount of the product’s price. Money shall be given back within 14 days to the bank account defined by the Buyer. Sanplast SA does not accept any delivery sent as cash on delivery. The cost of the product return will not be refunded.
32. At placing order the Buyer accepts her/his personal data to be placed in the data base of Sanplast SA and their processing for the purpose of contract realization. It is necessary for order realization to provide personal data and accept their processing for the purpose of order realization. The User is responsible for giving incorrect personal data.
33. The product contained in Sanplast SA website does not constitute a commercial offer as defined by the Civil Code.
34. The whole content of www.sanplast.pl website is protected by the copyright. All rights reserved. All materials (photos, products names and other published materials) cannot be used in any way (eg. copying, publishing) without the prior written permission from Sanplast SA, Wymyslowice 1, 88-320 Strzelno.
35. Any modification of www.sanplast.pl website by the User, without the prior permission of Sanplast SA, is forbidden.
36. The computer software used to create www.sanplast.pl website is protected by copyright.
37. Every User is obliged to use www.sanplast.pl website in accordance with the binding Polish law, social cooperation rules, these regulations and any other regulations contained in the website sub-pages.
38. It is particularly forbidden at www.sanplast.pl website:
a) any operation what can trammel or violate service functionality and its being used by other Users;
b) giving improper personal data, in particular, to create The User who does not exist in real life, giving other people personal data as own data, use other Users accounts or extend own account to another User;
c) any activity offending privacy and good name of other Users;
d) placing on the website or transferring by the website any illegal content and materials or conflicted with social cooperation rules, particularly vulgar or indecent and pornographic content and content commonly regarded as abusive or offending personal rights other people;
e) any activity of using any website function to sending and publishing non-ordered sales information, doing any lawless sales, advertising or promotional activity,
f) any activity of breaking the other entities rights, including copyrights.
39. The User who starts using www.sanplast.pl website accepts and acknowledges that Sanplast SA is not responsible for any direct, indirect or other harm resulting from the use of www.sanplast.pl or from information taken from this website.
40. Sanplast SA gives notice that due to the use of different materials (shower enclosures - powder painted aluminum, shower trays and bathtubs - sanitary acrylic) getting 100% surface colour conformity is not possible for all the products presented on the website. Some colour differences between shower enclosure and acrylic products are allowable.
41. Due to limitations of colours displayed on monitors, products colours presented on the website may slightly differ from real ones. That is why, before making decision on purchase please, check the colours with aluminium profiles and acrylic colours patterns available at our distributors.
42. With reference to the realization by Sanplast of active policy of continuous improvement of products, Sanplast reserves the right to change technical characteristic, colours, products and elements prices presented on the website or to remove them from the offer at any time and without prior notice and without any obligation on the part of Sanplast.
43. Information from the website can be changed any time without prior notification.
44. Sanplast SA reserves the possibility of some technical discrepancies and informational mistakes which might appear on the website. Sanplast SA shall make all efforts to remove such mistakes once noticed. Sanplast SA warns that using www.sanplast.pl website is done at the sole risk of the User.
45. Sanplast SA does not take responsibility for any possible mistakes on the website.
46. These Regulations are valid from the date of 20-09-2011. Sanplast SA reserves the rights to change the Regulations any time without prior notice. Regulations changes become valid for the Users from the date of its placing on the website.
47. Infringement of this Regulations by the User entitles Sanplast SA to take legal actions , in particular, suspend or remove such User’s account or inform authorized services and institutions about such breach of law.
48. Detailed instructions and regulations placed at www.sanplast.pl sub-pages do not exclude or limit the rules of these Regulations.
49. In all the issues not regulated by these Regulations, the relevant rules of Polish law are applicable Any disputes based on these Regulations will be governed by Polish general court of law.
